Terms of Service

1. Agreement to these terms

Xatheryn Connect (the "Service") is operated by Xatheryn LLC, a North Carolina limited liability company ("Xatheryn," "we," "us"). These Terms of Service ("Terms") are a binding legal agreement between you and Xatheryn LLC. In these Terms, "the Xatheryn Parties" means Xatheryn LLC and its members, managers, officers, employees and agents; every protection in these Terms for Xatheryn (including each disclaimer, release, indemnity, limitation of liability and the arbitration agreement) covers all of the Xatheryn Parties. By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Who can use Xatheryn Connect

Xatheryn Connect is only for people in the United States, including its territories. You may not create an account on or use the Service from outside the United States, and we block access from locations outside it.

You must be at least 18 years old to create an account or to use Xatheryn Connect. If you are under 18, do not create an account and do not use the Service, and please do not allow anyone under 18 to use it. By creating an account or using Xatheryn Connect, you represent and warrant that you are 18 or older, that the legal name, date of birth, and any other information you provide are accurate, and that you have not been previously suspended or removed from the Service under a different identity. Providing a false name or date of birth is a violation of these Terms and, depending on the nature of the misrepresentation, may also violate applicable law. If we learn from an ID check, a report, or anything else that an account belongs to someone under 18, we will suspend it, we may delete its content and personal information, and we may keep a minimal scrambled record of the device so that it cannot be used to open another account until that person is 18. We may also end any live and remove content that appears to show someone under 18.

Signing up. You can create an account without showing an ID. You enter your legal name, date of birth and gender, choose a Display Name, and make a passkey. You may not change your date of birth yourself after you submit it. Only one account may be created from a device, and we may refuse to create another from the same device. Your name and date of birth must be your own.

Your first 30 days. A new account has 30 days in which you may look around, post, comment, follow, add friends and go live without verifying your ID. Until you verify your ID: you cannot send or receive private messages (messages are only between people who have each verified their ID); you cannot use For hire or Real Deals; you cannot sign in to other Xatheryn apps (such as Map My Drive and Xatheryn Wire) with your Connect account; and your posts and profile are not included in Xatheryn Search. You do not need to verify your ID to look at, add or claim a business. A business is verified separately: to earn the "Verified owner" badge, the person claiming it gives an EIN (we keep only a scrambled code of it and do not check it with the IRS) and receives a code at an email address on the business's own website domain. You can verify your ID at any time, and when you do these open up. A member who has verified their ID may report an account that looks to be under 18, and we may ask any account to verify its ID at any time if something posted, said or reported about it makes us doubt that its holder is an adult.

Verifying your ID. To verify, you use a real, government-issued photo ID (such as a state ID, driver's license, or passport) through our identity verification provider. If your 30 days end without a passed check, or we ask you to verify and you do not pass within 48 hours of our asking, your account is locked: you can do nothing except verify your ID or sign out, and nothing is deleted. The name and date of birth on your ID must match what you entered; if your name matches and the ID shows an adult date of birth that differs from what you typed, we set your account's date of birth to the one on the ID, and if the ID shows that you are under 18 your account is suspended. Each ID can be used for one account. We do not store the image of your ID or your ID number. We keep only whether the check passed and a scrambled, one-way code made from your ID number (it cannot be turned back into the number), kept so the same ID cannot be used to open a second account. Our verification provider handles your ID, and any photo of your face it asks for, under its own privacy practices; we have set it to delete them one month after your check and not to use them to train its AI. We may also mark an account as verified ourselves without an ID check; we do not describe such an account as having had one. Accounts that were created with an ID check before October 2026 keep that check, and accounts created before September 22, 2026 are not required to complete one.

3. Your account

You are responsible for maintaining the confidentiality and security of your account and passkey credential, and for all activity that occurs under your account, whether or not authorized by you. You must notify us promptly of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account that occurs before you notify us.

Notifications. We do not ask for your email address or phone number to create your account, so notifications on your device are how we reach you about replies, safety issues, decisions about your account, and updates. We ask every member to turn them on, and until you do we may remind you often, including with a pop-up each time you open a page. You can use Xatheryn Connect without them, and you can turn notifications off at any time in your browser or device settings.

Business invite codes and free advertising days. Every business page has its own invite code and QR code. When someone signs up with it, passes our ID check as an adult, and is not the business owner or someone using the owner's ID or device, the business earns two free advertising days, up to 60 days banked. The days are a promotional credit: they have no cash value, cannot be sold, transferred or exchanged for money, and can only be used for advertising on Xatheryn. They do not expire while the business page stays in good standing. We may remove days that were earned through fake, duplicate or self-referred sign-ups or by breaking these Terms, and the days of a business page that is removed. We may change or end this program for future sign-ups at any time.

4. Your content and license to us

You retain all ownership rights in the content you post ("Your Content"). By posting Your Content, you grant Xatheryn Connect a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, distribute, and adapt Your Content solely to the extent necessary to operate, provide, promote, and improve the Service as it is designed to function (for example, showing your posts to other users, generating thumbnails, and enabling reposts and shares that you or others initiate, and, if you are 18 or older, making Your Content searchable in Xatheryn Search, our own search engine, as described in the Privacy Policy). This license ends when you delete Your Content or your account, except that: (a) content already shared, reposted, or reasonably retained by another user through a feature we offer at the time of posting may persist as part of their own content, and (b) we may retain copies as required for legal compliance, dispute resolution, or as described in the Privacy Policy's retention practices. You are solely responsible for Your Content and for having all rights necessary to post it, including rights to any photo, video, likeness, trademark, or vehicle you list or depict. You represent that Your Content does not infringe, misappropriate, or violate any third party's intellectual property, publicity, or privacy rights, and does not violate any applicable law.

5. Posting, sharing, and deleting content

You can delete any post you authored at any time; it is removed immediately, and we make reasonable efforts to remove it from any repost that references it, but see Section 4 regarding content already copied or retained by others outside features we provide. You can share (repost) another person's post to your own feed, optionally with your own caption; the original author is credited and notified. You can send a post directly to a mutual follow, either as a private message or as a public post on their profile page; both require you to already be mutual follows, and a private message also requires that both of you have verified your ID (Section 2). Posting in the News category is limited to accounts verified as journalists; everyone else can still read News content, including where it surfaces inside the Local and For You feeds. We do not pre-screen all content and are not responsible for content posted by users, but we may remove or restrict access to any content, at any time, for any or no reason, as described in Section 7.

Connect Live: you must be 18 or older to go live, and you do not need a number of followers to do it. Only a limited number of people can be live at once; when that limit is reached you wait in a line that you can see in the app and in your notifications, and we tell you when it is your turn and how long you have to start. Members who have verified their ID go ahead of those who have not. A member who has verified their ID may report a live that appears to show someone under 18; we may end that live at once, keep what was on air as evidence, and require the person live to verify their ID. You choose whether a live is for your followers or for all members, and your followers are notified when you go live. Everything in these Terms applies to what you show and say on a live and to live chat, which is moderated like any other content, and we may end any live at any time. We do not record or keep lives: the video is deleted when the live ends. Viewers can see your live only while it is on air, may be limited in number, and can send chat and flames that you can see. A clip you save from your own live is made and kept on your device; you are responsible for it and for having the rights to everything in it.

6. Prohibited conduct

You agree not to, and not to attempt to:

• Post or transmit content that is illegal, threatening, harassing, defamatory, obscene, or that exploits or endangers a minor;
• Post, share, or threaten to share a nude or sexual photo or video of another person without their consent, including one made or altered with software or AI to look like them (see Section 9);
• Engage in harassment, bullying, cyberstalking, or targeted abuse of another user;
• Infringe any patent, trademark, trade secret, copyright, right of publicity, or other intellectual property or proprietary right;
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity;
• Circumvent, disable, or otherwise interfere with security-related or moderation features of the Service, including by creating an alternate account to evade a suspension, block, or restriction;
• Use the Service to promote gambling, or to solicit or facilitate the sale of illegal goods or services;
• Scrape, crawl, or harvest data from the Service by automated means, or access the Service through any interface other than the one we provide, without our prior written consent;
• Reverse engineer, decompile, or attempt to derive the source code of the Service, or interfere with or disrupt the integrity or performance of the Service;
• Post or send the same or substantially similar content repeatedly in a manner that amounts to spam or flooding.

Violations may result in content removal, warnings, temporary restriction, or permanent account suspension, at our discretion, in addition to any other remedy available to us at law or in equity.

7. Content moderation, automated systems, and enforcement

We use a combination of automated systems and human review to detect and act on content or conduct that violates these Terms. Our automated moderation and account-integrity system is called Hall Monitor. It is operated by us on infrastructure we control, is separate from Echo, and is not an AI companion or personality you can talk to. We do not publish the specific rules, thresholds, or signals it uses, because doing so would help people evade it; nothing in these Terms entitles you to that information. It includes a rules-based system and a locally-operated AI classifier that evaluate reported and, in some cases, newly posted content. An automated system may determine that content should be allowed, flagged for human review, blocked, or escalated, and may take effect before any human reviews the decision. We do not guarantee that automated or human moderation will catch every violation, nor that it will never make a mistake in either direction. If you believe content was removed, or your account was restricted, in error, you may contact the site administrator to request review; we are not obligated to reverse any decision but will consider good-faith requests. We may also, at our discretion, ask you or another user how borderline content of a given type should be handled going forward, to refine our internal moderation configuration; a response to such a request does not obligate us to apply it to any specific case, past or future.

8. Echo (public AI account)

Echo is a public AI account, not a private companion or 1:1 chat assistant. Echo is not a real person, is not a licensed doctor, therapist, lawyer, or financial advisor, and nothing Echo says is professional advice. Echo can be wrong, including about facts, and you should not rely on it for anything that matters without checking it yourself. Echo speaks as a single persona. Echo's account is labelled with an AI badge wherever it appears.

What Echo says. Echo's replies are written by an AI and are not reviewed by anyone before they appear, and they are not moderated by Hall Monitor. Echo is sarcastic and can be blunt, use strong language, and give opinions, including on politics. Those opinions come from an AI. They are not statements of fact, and they are not statements or endorsements by Xatheryn LLC. Echo is instructed not to tell anyone how to vote, but it can get things wrong, and nothing it says is voting, legal, medical or financial advice. You can hide swear words for yourself under Echo settings in the account menu, and you can report any comment from Echo like any other comment.

Where Echo appears. Echo posts a daily news and weather roundup from its own account. It may leave a single comment of its own on a public post, at most one per post. You can tag Echo in a comment to get a public reply; to do that you must follow Echo's account, and tagging is rate limited, currently one tag per hour per account, which we may change, including as part of a future paid tier. Anything Echo posts is visible to anyone who can see that post or comment. Echo's weather content uses the location saved on your account (see the Privacy Policy).

We may adjust Echo's configuration, including instructions that shape its tone and behavior, at any time and without separate notice. We may also limit, suspend, or withdraw any part of Echo at any time.

9. Copyright (DMCA) and intimate images (Take It Down)

We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act. If you believe your copyrighted work has been used on the Service in a way that infringes your rights, submit a notice through our DMCA page. Submitting a knowingly false claim may expose you to liability, including under 17 U.S.C. §512(f). We may terminate the accounts of users determined to be repeat infringers.

Intimate images shared without consent. Sharing a nude or sexual photo or video of a person without their consent, including one made or altered with software or AI to look like them, is against these Terms and can be a federal crime, and we remove it. If such an image of you was shared on the Service, you, or a person you have authorized to act for you (such as a parent, lawyer or advocate), can ask us to remove it through our Take It Down page. You do not need an account. When we receive a valid request we hide the photo or video, and, as the federal TAKE IT DOWN Act requires, we remove it and make reasonable efforts to find and remove identical copies within 48 hours of receiving the request. If the person pictured may be under 18, we do not delete the file: we keep it, hidden from everyone except our staff, because the law requires us to. We may remove such content, and restrict or suspend the account that posted it, whether or not anyone has asked. Anyone else who sees such an image should use the Report button.

We may decline a request that is not valid, that is not about an intimate image or video, or that we believe was not made in good faith, and we may stop hiding content automatically for requests from anyone who has made false ones. If something you posted was removed and you think we made a mistake, you may write to the site administrator; we are not obligated to restore it, and we will not restore an intimate image without the consent of the person pictured. Nothing in this Section limits our right to remove any content as described in Section 7.

10. Real Deals marketplace

Real Deals lets adults list a vehicle, or another permitted item, for sale by auction. You must be 18 or older, and have verified your ID (Section 2), to list, bid, buy, comment or message in Real Deals.

How an auction works. Every auction runs for 7 days, and the 7 days start when the first bid is placed, not when the item is listed. A listing that gets no bid within 30 days of being listed ends with no sale. The seller sets a starting bid, which is public, and a Buy It Now price. Each new bid must beat the current high bid by at least $1. A bid at or above the Buy It Now price is treated as Buy It Now at that price, and Buy It Now ends the auction right away. You can't bid on your own listing, and you can't bid on a listing from someone you and that seller both follow (mutual followers can arrange a private sale instead).

Bids are binding. A bid is your promise to buy at that price if you win, and Buy It Now is your promise to buy at the Buy It Now price. Listing an item is the seller's promise to sell to the winner at the winning price. These promises are made directly between the buyer and the seller, not with Xatheryn. Until the first bid, the seller can edit or withdraw a listing. Once an auction has any bid, the seller can no longer edit or withdraw it, and it runs until it ends.

Relisting. A listing that ends with no bids can be relisted, with the Buy It Now price at least 5% lower. Deleting or withdrawing an item and posting it again to get around this rule is prohibited. We detect when the same item is listed again (for example by matching photos, similar titles, or the same vehicle make, model and year) and hold it to the lower price, and repeated attempts can lead to enforcement under Section 7.

Listing requirements. Every listing needs at least one photo, and the seller must confirm that the photos show every flaw the item has. A vehicle or other motorized item must list a place where buyers can see and test drive it. That place must never be your home; use a busy public place. Test drives and inspections happen at the risk of the people taking part, not Xatheryn.

Talking about a listing. Questions and answers happen in public comments on the listing. Private messages open only between the seller and the winner, and only after the item sells. If a seller leaves a question unanswered for 48 hours, the person who asked can report the seller as not responding. When three different people report the same seller as not responding within 30 days, that seller is blocked from Real Deals for 90 days and their active listings are withdrawn. This happens automatically.

Payment and fees. Payment happens in person between the buyer and the seller. Xatheryn does not charge fees to list or sell at this time; if that ever changes, we will say so in these Terms before it applies to you.

Xatheryn is only a venue. Xatheryn is not the seller, an auctioneer, a broker, a dealer, an escrow agent or a payment processor, and is not a party to any sale. Items are sold as is. We do not inspect or verify any item's condition, title, legal ownership, mileage or history, or the seller's right to sell it, and we do not guarantee that a sale completes or that either party performs. Buyers and sellers are solely responsible for exchanging money, title and possession themselves, and for following every law that applies to the sale, including vehicle titling, odometer disclosure and sales tax.

11. For hire

For hire lets a business or a solo freelancer on Connect list the work they do, and lets other members find them, request a quote, sign a Service Agreement, and keep an invoice and receipt for the job. You must be 18 or older, and have verified your ID (Section 2), to use For hire, request a quote or take jobs.

A directory, not an employer. For hire is a directory. Xatheryn is not an employer, staffing agency, agent, broker, guarantor, escrow agent, payment processor or contractor for anyone listed, and does not perform, supervise or control any work. Providers are independent businesses, not employees or representatives of Xatheryn.

Promises before your first job. Before you first turn on Take jobs, you must accept the provider promises, and before your first quote request, the customer promises. We record when you accepted and which version, and ask again when they change.

The Service Agreement is only between the two of you. When a provider accepts a request, Connect creates a prefilled Service Agreement for that job. The provider fills in the price, payment method, when payment is due, and any deposit; the customer can correct the description of the work. Each party signs by tapping "I agree", which stamps the legal name on their account and the date and time, and is their electronic signature. The job is booked only after both have signed, and the agreement is then locked. Any later change to the work or price must be a written change order in the job that both parties sign before the extra work is done. Every Service Agreement and change order is solely between the provider and the customer. Xatheryn LLC provides only the software used to create it, is not a party to it, and has no obligations or liability under it. Both parties agree, in the agreement itself, to release, indemnify and defend the Xatheryn Parties for anything arising from the job. We suggest having a lawyer review the agreement for a large job.

Deposits. A provider may take a deposit or any upfront payment only if its amount and what it covers are written in the signed Service Agreement.

Nothing is verified. We do not run background checks on anyone. We do not verify licenses, insurance, bonding, qualifications or the quality of anyone's work. When a listing says "License # provided", it means only that the provider typed in a license number; it is self-reported and we have not checked it. In a trade that usually needs insurance, a provider has to enter their insurance company, its phone number, their policy number and the date it runs out; those are shown only to the customer of a job, never on the public listing, and we do not check them, so call the insurance company yourself. Check licenses, insurance and references yourself before hiring anyone. A "Verified owner" badge means only that the person who claimed the business received a code at an email address on the business's own website domain, and gave an EIN that we have not checked with the IRS; it says nothing about its work.

Providers' responsibilities. If you take jobs, you are responsible for holding every license, permit and insurance policy your work requires, for paying your own taxes, and for following every law that applies to your work. Listings in licensed trades must include a license number, and it must be real and yours.

No money moves through Connect. Customers pay providers directly (for example cash, card in person, Venmo or check). Xatheryn does not take, hold or confirm payments, is never a payee on any agreement, invoice or receipt, and never collects or stores card or bank account numbers. Never pay a deposit to someone you do not know unless it is written in your signed Service Agreement, and meet safely.

Invoices and receipts. The invoice and receipt tools are a record-keeping convenience between the two people on a job. They are not tax, legal or accounting documents, and Xatheryn does not confirm that any payment shown on them was actually made. If an invoice is not marked paid within 30 days, the job closes automatically as "Closed, unpaid", without counting as a finished job or allowing a review.

Records are deleted. Job records (the request, the Service Agreement and change orders, the job chat, and the invoice and receipt) are deleted 24 hours after the job closes; save or print anything you need before then. If either person files a report during a job or before its records are deleted, that job's records are kept for 30 days from the report (visible only to the two people and our administrators) and then deleted. We keep only reviews and each business's count of finished jobs.

Not responsible for the work. Xatheryn is not responsible for any work done or not done, its quality or safety, any injury, illness, death or property damage, any no-show or late arrival, any price, deposit or payment dispute, or anything else that happens between a customer and a provider.

Prohibited services. For hire may not be used to offer or request escort or companionship services, massage of any kind, adult or sexual services, drugs or prescriptions, weapons, anything illegal where the work would be done, or anything else that breaks these Terms. Listings, service names, quote requests, Service Agreements, change orders, job chats and reviews are checked by Hall Monitor and our moderation rules like the rest of Connect.

Reviews. Only the customer on a job the provider marked paid can leave one review of that job. Reviews must be honest and about the job, and may not be traded for free or discounted work.

Reports and blocks. Anyone on a listing or a job can report it. Reasons on a job include no-show, abandoning the job, damaging property, not paying, and fake payment. When three different people report the same person on For hire within 30 days, that person is blocked from For hire for 90 days and their listing is hidden. This happens automatically, and we may also take any action described in Section 7, including banning accounts and cooperating with law enforcement in cases of fraud. New accounts can send only a small number of quote requests each day.

12. Disputes between users; release

Any sale, job, payment or other dealing you have with another user, including through Real Deals or For hire, is solely between you and that user. Xatheryn has no obligation to get involved in any dispute between users, although we may choose to help or to take moderation action.

To the fullest extent permitted by law, you release the Xatheryn Parties from all claims, demands, damages and losses of every kind, known and unknown, arising out of or in any way connected with any dispute between you and another user, or with any item, sale, job, work, payment, meeting or test drive involving another user. If you live in California, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law of any other state as well. You will not name any of the Xatheryn Parties in any lawsuit, claim or complaint about a dispute with another user, a sale, or a job.

13. The Android app and Google Play

Xatheryn Connect is offered as a website and as an Android app, and Xatheryn LLC operates both. The app is the same Service: these Terms and our Privacy Policy apply to everything you do in it exactly as they apply on the website.

Downloading from Google Play. We offer the app through Google Play, which is run by Google. Google's own terms and policies, including the Google Play Terms of Service, apply to your download, installation and updates of the app and to your Google account. Those terms are between you and Google. Google is not a party to these Terms, does not operate Xatheryn Connect, and is not responsible for the Service, its content, or support for it; questions and problems about Xatheryn Connect come to us, not to Google.

Google Play does not change who may use Connect. Whether the app is visible on Google Play, the countries, devices, age groups or audiences it is listed for, and how Google Play labels or rates it have no effect on who may use Xatheryn Connect. Being able to see, find or download the app does not mean you may use it. The minimum age is still 18: you must be at least 18 years old to create an account or to use Xatheryn Connect, in the app, on the website or in any other way, and Section 2, including the United States only rule, applies to the app in full. If you are under 18, you may not create an account or use Xatheryn Connect, even if the app is shown or offered to you.

Accounts under 18. If we learn, from an ID check, a report or anything else, that an account belongs to someone under 18, we will suspend or close it, as Section 2 describes, and we may delete its content and personal information. This applies equally to an account made in the app. As Section 2 describes, we may ask an account to verify its ID with a real, government-issued photo ID, and an account that does not pass the check in the time Section 2 allows is locked.

14. Third-party content and links

The Service may display content, links, GIFs, or media sourced from third parties (for example, a GIF search provider). We do not control and are not responsible for third-party content, and its presence does not imply endorsement.

15. Disclaimer of warranties

The service and all content on it are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the service or the servers that make it available are free of harmful components. We do not guarantee the accuracy, completeness, or reliability of anything posted by a user, including any Real Deals listing, any For hire listing, license number, review, invoice or receipt, any news content, or any moderation decision. We do not warrant any item sold, any work done, or any user. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, in no event will any of the Xatheryn Parties be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the service, any content posted by any user, any sale, auction, bid or transaction through Real Deals, any job, quote, work, invoice, receipt or payment through For hire, any meeting, test drive, injury or property damage connected with another user, or any conduct of any user or third party on or off the service, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total cumulative liability to you for all claims arising out of or relating to these terms or the service will not exceed the greater of (a) the total amount, if any, you paid us in the twelve months before the claim arose, or (b) one hundred united states dollars ($100). Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless the Xatheryn Parties from and against any claims, liabilities, damages, losses, and expenses, including fines, penalties and reasonable attorneys' fees, arising out of or in any way connected with: your access to or use of the Service; Your Content; your violation of these Terms; your violation of any right of a third party, including any intellectual property, privacy, or publicity right; any transaction you enter into with another user, including any sale or auction through Real Deals; any job, work, service, invoice or receipt through For hire, including any claim that you lacked a license, permit or insurance, or that your work caused injury or property damage; or any dispute between you and another user.

18. Dispute resolution; arbitration agreement; class action waiver

Please read this section carefully. It affects your legal rights. You and Xatheryn LLC (on behalf of itself and the Xatheryn Parties) agree to first attempt to resolve any dispute informally by contacting the site administrator. If a dispute is not resolved within 30 days, you and Xatheryn LLC agree that it will be resolved by binding, individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. You and Xatheryn LLC each waive any right to a jury trial and to participate in a class, collective, or representative action. This arbitration agreement is governed by the Federal Arbitration Act. It covers any claim against any of the Xatheryn Parties, including a claim about a Real Deals sale or a For hire job or Service Agreement, and it controls over anything in a Service Agreement or other agreement between users. Where applicable law does not permit enforcement of any part of this section, that part will not apply to the extent (and only to the extent) required by that law, and the remainder of this section will still apply.

19. Governing law

These Terms are governed by the laws of the State of North Carolina, where Xatheryn LLC is organized, without regard to its conflict-of-laws principles, except as otherwise required by applicable law, including any consumer-protection law of your state of residence that cannot be waived.

20. Account termination

We may suspend or remove an account that violates these Terms, or for any other reason, at our discretion, with or without notice. You can stop using the Service at any time, and you can delete your own account from Settings: we ask you to confirm with your passkey, send a link to the email address you enter, and delete the account permanently when you confirm from that email. Deletion cannot be undone, and it waits while a report against you is open or you have an unfinished For hire job or an active Real Deals listing. Sections of these Terms that by their nature should survive termination, including ownership, the release in Section 12, disclaimers, limitation of liability, indemnification, and dispute resolution, survive any termination of your account or these Terms.

21. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Xatheryn LLC regarding the Service.

22. Changes to these terms

We may modify these Terms as the product changes. We will update the date at the top of this page when we do, and for material changes we will make reasonable efforts to provide additional notice (for example, an in-app notification). Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
