Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Xatheryn Search (“Search,” “we,” “us,” or “our”) governing your access to and use of the Xatheryn Search web search engine (the “Service”). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that you have your parent or legal guardian’s permission to use the Service.

2. Description of the Service

Search returns results from our own index of the public web in response to queries you submit. Search is a general web search engine and is not, and will not be offered as, a tool for locating or compiling information about a specific person’s identity, location, or likeness. See our Privacy Policy, Section 1, for the specific commitment this reflects.

3. Your Account

If you sign in, you do so using the shared Xatheryn account described in our Privacy Policy. You are responsible for all activity that occurs under your account. Notify us immediately at the contact address in Section 9 if you suspect unauthorized access.

4. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose, including to locate, harass, or compile information about a specific individual without their consent; (b) use automated means to scrape, index, or systematically extract search results at scale; (c) attempt to circumvent the Service’s content-safety filtering; (d) interfere with or disrupt the integrity or performance of the Service; or (e) attempt to gain unauthorized access to the Service or its related systems.

5. No Guarantee of Results

Our index is small and growing, built independently rather than licensed from an existing provider. We do not guarantee that any particular page, topic, or query will return results, or that results will be complete, accurate, or up to date.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SEARCH RESULTS WILL BE ACCURATE OR COMPLETE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SEARCH, ITS OWNERS, OFFICERS, OR OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING RELIANCE ON ANY SEARCH RESULT OR A LINKED THIRD-PARTY PAGE WE DO NOT CONTROL.

8. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of laws principles.
